am i fat (pic included), and weight loss ?

Im 12 (ill be 13 in april) and I weigh around 115 pounds. this is my pic:

and my waist is 32 inches,
my weight loss goal is 96 asap. any tips/excercise/diet schedule? (cant take diet pills)
